By accessing or using our website, platform, mobile applications, or purchasing our listing plans, lead packages, banner spaces, or digital marketing services, you (“User”, “Contractor”, “Vendor”, “Client”) agree to be bound by these Terms and Conditions.
If you do not agree to these terms, please do not use this platform.
BALLUThekedar operates strictly as an “Intermediary” under Section 79 of the Information Technology Act, 2000.
We are a nationwide online directory marketplace and advertising aggregation platform connecting users/property owners with independent third-party contractors, freelancers, and service providers.
We do not directly or indirectly provide construction, renovation, electrical, plumbing, or any physical labor/engineering services.
By purchasing any of our commercial offerings, you agree to the specific product rules outlined below:
Subscription Plans (Starter, Growth, Elite): These plans grant visibility and premium placement on the directory for a specified duration.
Lead Packages: Vendors can purchase individual or bundled leads (user project queries). We act solely as a pipe to deliver user contact data.
Banner Advertisements & Digital Marketing: We provide dedicated digital space and technical campaign setups to promote vendor brands.
All commercial transactions on BALLUThekedar are final.
No Refunds for Leads: We do not guarantee the response rate, conversion, or financial backing of any lead. Once a lead is purchased or delivered, no refunds or credits will be issued under any circumstances, even if the lead turns out to be unresponsive or does not convert into a project.
No Marketing/Ad ROI Guarantees: We provide marketing visibility, not guaranteed revenue. No refunds are applicable based on campaign performance or low call-volumes.
Subscription Cancellations: Users can cancel their subscriptions at any time from their dashboard, but no pro-rata refunds will be given for the remaining unused period.
To the maximum extent permitted by applicable Indian laws, BALLUThekedar and MONIL Corpus assume ZERO liability for:
Offline Disputes: Any financial fraud, property damage, delays, poor work quality, structural defects, personal injuries, or breach of contract between the Client and the Contractor offline.
Verification Limitation: While we encourage genuine profiles, it is the sole responsibility of the Client to physically verify the identity, licenses, skills, and past records of a Contractor before handing over money or projects.
Loss of Business: Any direct, indirect, incidental, or consequential financial losses incurred by Vendors or Clients due to website downtime or system errors.
Users and Vendors strictly agree not to:
Post false, misleading, duplicate, or plagiarized information/portfolio images.
Infringe upon the copyright or intellectual property rights of other businesses.
Post abusive, illegal, political, or defamatory content.
We reserve the absolute right to suspend, terminate, or delete any listing or active paid account without notice and without refund if found violating these rules.
You agree to indemnify, defend, and hold harmless BALLUThekedar, MONIL Corpus, its directors, employees, and agents from any claims, damages, legal costs, or demands raised by third parties due to your breach of contract, offline professional misconduct, or violation of any Indian law.
These Terms and Conditions are governed by and construed in accordance with the federal laws of India. Any legal actions, disputes, or proceedings arising out of or relating to BALLUThekedar shall be subject exclusively to the competent courts of Bhopal, Madhya Pradesh, India.
